TERMS AND CONDITIONS

PLEASE READ THIS AGREEMENT CAREFULLY. THIS IS A LEGAL DOCUMENT AFFECTING THE LEGAL RIGHTS OF EACH GUEST THAT PURCHASES A TICKET OR PARTICIPATES IN A TOUR.

By purchasing tickets for and/or participating in the cultural and food tours (“Tour” or “Experience”) offered by Wander With Nada, powered by Frying Pan Adventures LLC (the “Company”), the guest (“You” or “Guest”) agrees to be bound by the following provisions of this waiver and its release of liability (“Waiver”). You represent that you are 18 years of age or older. If you are bringing a minor as a Guest, you acknowledge and agree that you are solely responsible for the supervision of that minor throughout the duration of your Experience, and have read this Guest Release and Waiver and agree to it on the minor’s behalf. If you are booking an Experience on behalf of other Guests, you will ensure, and you represent and warrant, that each Guest on whose behalf you book has read and agreed to this Guest Release and Waiver, which shall apply to each of them as if the reference to "You" was a reference to him/her.

Assumption of Risks

You fully comprehend and acknowledge all of the risks associated with your participation in the Tour(s) including, without limitation, injury or illness, including exposure to unfavorable weather conditions, sickness, allergic reactions, choking, injuries arising from self-inflicted accidents or mishaps, other participants, motor vehicles, and pedestrians. You understand that the Tour(s) takes place in public venues under conditions largely beyond the Company’s control.

To the maximum extent permitted under applicable law, You knowingly, voluntarily, and freely assume all risks of participating in the Tour(s), and You assume full responsibility for participating in the Tour(s).

Standard Release and Waiver

You acknowledge and agree that:

  • You have reasonably assessed the risks involved in the Tour(s) and have made an informed and voluntary choice to participate.

  • You are responsible for determining your fitness for participating in the Tour(s)

  • You will not participate in any Tour(s) when you have a physical, medical, or mental limitation or disability

  • You will act reasonably and responsibly and will comply with any provided and customary conditions, directions, and/or precautions for participation in the Tour(s)

  • You unconditionally release the Company and any affiliated entities, contractors, and employees from any and all claims, actions, damages, liabilities, losses, costs and expenses resulting from your participation in the Tour(s)

Coronavirus/COVID-19 Release and Waiver

You acknowledge and agree that:

  • You are aware of the contagious nature of Coronavirus/COVID-19

  • You acknowledge that the Company has put in place precautionary measures to protect guests from Coronavirus/COVID-19

  • You acknowledge that the Company cannot guarantee that you will not become infected with the Coronavirus/COVID-19

  • You attest that you are not experiencing any symptom(s) of Coronavirus/COVID-19

  • You attest that you have not tested positive for Coronavirus/COVID-19 AND not yet cleared as noncontagious by public health authorities

  • You unconditionally release the Company and any affiliated entities, contractors, and employees from any and all claims, actions, damages, liabilities, losses, costs and expenses resulting from your participation in the Tour(s)

By checking ‘Yes’ on the submission form, You confirm that you have read the Terms and Conditions and that your participation in the Tour(s) is expressly subject to your acceptance of the Terms and Conditions of this agreement on behalf of yourself and on behalf of any minor for whom you are making payment for or bringing with you on the Tour(s).
